Just because drunk driving is a common traffic violation, doesn't mean it is not serious. Penalties can include loss of driving privileges, stiff fines, and jail sentences. The loss of your driver's license can lead to the loss of your ability to work and earn a living. Any drunk driving conviction can put your professional license in jeopardy.

If this is your first drunk driving arrest and you weren't involved in an accident with injuries, I would advise you to take the roadside breathalyzer test. You will most likely be required to take the alcohol education program. For a subsequent offense, there is a mandatory minimum of 48 hours in jail or 100 hours of community service.

If you have been previously charged with a DUI or if your drunk driving incident involves an accident with injuries, do not take the breathalyzer test. In these circumstances you should also politely decline to take any field sobriety test, such as standing on one foot or walking a straight line.
